Frequently asked questions
Common questions about statutory leave across Asia.
No โ every country has different statutory minimums. Singapore grants 7โ14 days (scaling with tenure), Malaysia grants 8โ16 days, Indonesia grants 12 days (after 12 months service), Vietnam grants 12โ16 days, and India's entitlements vary by state. These are minimums; your employment contract can be more generous.
It depends on the country and employer policy. Singapore law allows employers to forfeit untaken leave if not taken within 12 months. Malaysia requires leave to be taken within the same calendar year. Indonesia requires leave to be taken within 6 months of accrual. Many employers allow some carry-over โ check your employment contract.
In Singapore and Malaysia, the Employment Act provides two tiers: outpatient sick leave (14โ22 days, for clinic visits) and hospitalisation leave (60 days, for inpatient stays). Hospitalisation leave includes the outpatient days โ it's not additive. Other countries don't always make this distinction explicitly.
In most countries, maternity leave begins shortly before the expected delivery date. Singapore provides 16 weeks (citizens/PRs) โ typically 2 weeks before and 14 weeks after. Malaysia provides 98 days. Vietnam provides 6 months. The employer pays first, then claims reimbursement from government social insurance funds in most cases.
Leave is usually pro-rated for employees who join mid-year. For example, if you join Singapore on 1 July, you'd be entitled to approximately half your annual leave for that year (rounded to the nearest day). The exact formula varies by employer โ some round up, others round to the nearest half-day.
Generally yes for untaken annual leave upon resignation or contract end. During employment, paying-in-lieu of annual leave is restricted in Singapore and Malaysia โ employees must actually take the leave. Sick leave typically cannot be encashed. Check your employment contract for specific provisions.
